By purchasing services or products from SEODesignLab, LLC (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and SEODesignLab, LLC, a Florida limited liability company.

2.1 Service Offerings

We provide digital marketing services including but not limited to:

Search Engine Optimization (SEO)
Pay-Per-Click Management (PPC/Google Ads)
Website Design and Development
Content Creation and Optimization
Local SEO Services
Conversion Rate Optimization
Social Media Marketing

2.2 Website Platform

All websites developed by SEODesignLab are built exclusively on WordPress using professional tools including:

WordPress CMS (latest stable version)
Elementor Pro page builder
Ultimate Addons for enhanced functionality

We maintain and update these core components as part of our hosting service.

3. Hosting Services & Lifetime Hosting Guarantee

3.1 Definition of “Lifetime” Free Hosting

“Lifetime” Defined: For purposes of our hosting guarantee, “lifetime” means:

For One-Time Website Purchases: The operational lifetime of SEODesignLab, LLC as a business entity, or until you request cancellation of hosting services
For Monthly Subscriptions: The duration of your active monthly subscription with SEODesignLab

3.2 Lifetime Free Hosting Terms

All service packages include complimentary lifetime hosting with the following specific conditions:

For One-Time Website Design Purchases:

Hosting is provided free for the lifetime as defined above
No monthly or annual hosting fees will be charged by SEODesignLab
Client remains responsible for:
- Annual domain registration fees (paid to domain registrar)
- Any third-party service fees (SSL certificates if premium, CDN services, etc.)
Hosting includes:
- WordPress hosting on our managed servers
- Regular WordPress core updates
- Elementor Pro and Ultimate Addons updates
- Basic security monitoring
- Daily backups (retained for 30 days)

For Monthly Subscription Services (SEO/PPC):

Free hosting continues as long as monthly subscription remains active and in good standing
Hosting remains free if transitioning between our monthly services without gap
Includes all features listed above for one-time purchases

3.3 Hosting Limitations and Exclusions

The following are NOT included in lifetime free hosting:

Domain name registration or renewal fees
Premium SSL certificates (basic SSL included)
Email hosting (can be added separately)
Excessive bandwidth usage (over 100GB/month)
Excessive storage (over 10GB)
E-commerce transaction fees
Third-party plugin licenses beyond Elementor Pro/Ultimate Addons

3.4 Hosting Termination Conditions

Free lifetime hosting will be terminated under the following circumstances:

Upon Cancellation of Monthly Services:

Clients have thirty (30) days from cancellation date to migrate their website
We will provide one (1) complete backup file upon request
After 30 days, we reserve the right to remove the website from our servers
Written notice will be provided before deletion

For Non-Payment:

Websites may be suspended fourteen (14) days after a missed payment
Email notification will be sent before any suspension
Websites can be reactivated upon payment of outstanding balances
After 60 days of non-payment, hosting may be permanently terminated

For Violation of Terms:

Illegal content or activities
Excessive resource usage affecting server performance
Security breaches caused by client negligence
Violation of our Acceptable Use Policy

4. Orders and Payment

4.1 Order Acceptance

Orders become binding upon our acceptance and confirmation
We reserve the right to refuse service to anyone for any reason
Prices and service descriptions are as agreed upon at time of order placement

4.2 Payment Terms

Payment is due upon receipt of invoice unless otherwise specified
Monthly subscriptions are billed in advance on the same calendar day each month
All prices are in U.S. dollars unless otherwise specified

4.3 Taxes

Client is responsible for all applicable sales taxes, use taxes, and other government-imposed fees based on their jurisdiction.

5. Warranties, Guarantees, and Refund Policy

5.1 90-Day Money-Back Guarantee

We offer a full 90-day money-back guarantee on all eligible services. This guarantee demonstrates our confidence in delivering measurable results for your business.

Request must be submitted within 90 days of service start date
Applies to SEO, PPC, web design, and marketing services
Excludes third-party costs (ad spend, domains, etc.)
Full refund for monthly services within guarantee period
Prorated refund for partially completed projects

5.2 How to Cancel and Request a Refund

5.3 Service Warranties and Disclaimers

What We Guarantee:

Professional service delivery according to industry best practices
Implementation of agreed-upon strategies and deliverables
Transparent reporting and regular communication

What We Cannot Guarantee:

Specific search engine rankings or positions
Exact traffic volumes or visitor numbers
Guaranteed sales or conversion figures
Results dependent on third-party platforms (Google, Facebook, etc.)

5.4 Satisfaction Commitment

If you’re not satisfied with our services:

First 90 Days: Eligible for full money-back guarantee
After 90 Days: Month-to-month contracts with 30-day cancellation
Ongoing Support: Dedicated account manager to address concerns

5.5 Effect of Cancellation

Services continue until end of current billing period
Website hosting continues for 30 days (see Section 3.4)
Final deliverables package provided
Smooth transition of all accounts and assets

6. Client Responsibilities

6.1 Cooperation

Client agrees to:

Provide timely access to necessary accounts and platforms
Respond to requests for information within reasonable timeframes
Review and approve deliverables as requested

6.2 Content and Materials

Client warrants ownership or proper licensing of all provided content
Client is responsible for the accuracy of all provided information
Client maintains responsibility for website content compliance with applicable laws

7. Intellectual Property

7.1 Client Materials

All materials provided by the client remain the property of the client.

7.2 Company Work Product

Unless otherwise agreed in writing:

Custom designs and code created for client become client property upon full payment
We retain the right to display work in our portfolio
Standard templates, frameworks, and methodologies remain our property

7.3 Third-Party Components

Certain components (themes, plugins, stock images) may be subject to separate licensing terms.

8. Limitation of Liability

8.1 No Guarantee of Specific Results

While we employ industry best practices and proven strategies, we cannot guarantee:

Specific search engine rankings
Exact traffic volumes
Particular conversion rates or sales figures

8.2 Limitation on Damages

Our total liability shall not exceed the amount paid by client in the three (3) months preceding any claim.

9. Modifications and Termination

9.1 Right to Modify

We reserve the right to modify these Terms with thirty (30) days written notice for existing clients.

9.2 Termination Rights

We may terminate services immediately for:

Violation of these Terms
Non-payment exceeding 30 days
Illegal or unethical use of services
Actions that harm our reputation or operations

10. General Provisions

10.1 Governing Law

These Terms are governed by the laws of the State of Florida.

10.2 Entire Agreement

These Terms, along with any signed service agreements, constitute the entire agreement between parties.

10.3 Severability

If any provision is deemed invalid, all other provisions remain in full effect.

10.4 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control.

12. Dispute Resolution

12.1 Good Faith Resolution

Parties agree to attempt resolution through good faith negotiation before pursuing legal action.

12.2 Arbitration

Disputes not resolved through negotiation shall be settled through binding arbitration in Volusia County, Florida.
